11.2 For users located in the European Union or United Kingdom, nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. EU and UK consumers retain all statutory rights that cannot be waived by contract.

12. Assumption of Risk

By participating in any BREATHE & BELIEVE GLOBAL event, experience, or offering (the "Event"), you acknowledge that participation may involve inherent risks, including but not limited to physical activity, emotional experiences, and group environments. You voluntarily assume all risks, whether known or unknown, and accept full responsibility for your participation. You further acknowledge that you are solely responsible for determining your physical, mental, and emotional readiness to participate. For users in the EU and UK, this assumption of risk does not waive any statutory rights you may have under applicable consumer protection law.

13. Health Disclaimer

BREATHE & BELIEVE GLOBAL provides experiences intended for personal growth, reflection, and general wellbeing. These experiences are not medical, psychological, or therapeutic services. Nothing provided through the Site or any Event is intended to diagnose, treat, cure, or prevent any medical or mental health condition. You acknowledge that you are responsible for your own health and wellbeing. We strongly recommend that you consult with a qualified medical or mental health professional before participating in any Event, particularly if you have any pre-existing physical or mental health conditions, are pregnant, or have any history of cardiovascular, respiratory, or psychiatric conditions. Breathwork and similar practices may not be appropriate for everyone and carry specific contraindications that you should discuss with your healthcare provider prior to participation.

14. Participation Waiver

14.1 By participating in the Event you consent to be photographed and to be included in the filming of footage documenting the Event.

14.2 You hereby waive any and all rights of publicity or privacy and grant the Company a royalty-free, sub-licensable license to utilise and exploit your appearance in the Event in any and all manner and media throughout the world in perpetuity.

14.3 You further agree that the Company has the sole discretion to use or refuse to use any photographs or footage in which you appear, and that if the Company does use such photographs or footage, it may be edited at the Company's sole discretion.

14.4 If you do not wish to be photographed or filmed, you must notify the Company in writing prior to the Event at hello@breatheandbelieveglobal.com. We will make reasonable efforts to accommodate your request, however we cannot guarantee that incidental capture will not occur in group settings.

14.5 For participants located in the EU or UK, the collection and use of your image constitutes processing of personal data under the GDPR and UK GDPR respectively. Such processing is carried out on the basis of your consent as provided above. You have the right to withdraw this consent at any time by contacting hello@breatheandbelieveglobal.com, though withdrawal will not affect any processing already carried out prior to withdrawal.

15. Release of Liability

15.1 In consideration for being permitted to participate in the Event, you hereby waive, release, and forever discharge, for yourself, your heirs, executors, administrators and legal representatives, any and all rights and/or claims which you have, may have, or may hereafter accrue against the Company, its officers, directors, employees, consultants, agents and Event sponsors for any and all damages, personal injuries (including death). You further covenant not to sue the Company, its officers, directors, employees, consultants, agents and Event sponsors for any and all damages, personal injuries (including death), and/or claims which may be sustained directly or indirectly arising out of participation in the Event. This release and discharge includes, but is not limited to, claims for personal injury, death, property damage, economic loss, breach of contract, lost wages, contribution indemnity, indemnity, punitive damages, negligence, or any other legally recognisable claim arising out of participation in the Event, including all legal costs associated with such claims.

15.2 For participants located in the EU or UK, this release does not and cannot exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded under applicable law. Your statutory rights as a consumer under EU or UK law are not affected by this release.

16. Indemnity

You agree to release, defend, indemnify, and hold harmless the Company, its officers, directors, employees, consultants, agents, Event sponsors, licensees and assigns from and against any and all claims, demands, damages, suits, liabilities or actions arising directly or indirectly out of your actions or participation in the Event, whether made during or after the Event, including all associated costs, expenses, and any amounts paid as settlement or compromise. For participants located in the EU or UK, this indemnity applies to the fullest extent permitted by applicable law and does not affect any non-waivable statutory rights.

17. Cancellation and Cooling-Off Rights

17.1 For users located in the European Union or United Kingdom, you have the right to cancel a purchase or booking within 14 days of the date of purchase without giving any reason (the "Cooling-Off Period"), in accordance with the EU Consumer Rights Directive and the UK Consumer Contracts Regulations 2013.

17.2 To exercise your right to cancel, you must inform us of your decision by contacting us at hello@breatheandbelieveglobal.com within the Cooling-Off Period. We will reimburse any payments received from you without undue delay and no later than 14 days after we receive notice of your cancellation.

17.3 Please note that the right to cancel may not apply where services have already commenced with your prior express consent before the end of the Cooling-Off Period, or where the event or experience is scheduled to take place within the Cooling-Off Period and you have acknowledged that the right to cancel will be lost upon commencement.

17.4 For all other users, cancellation and refund rights are subject to the specific terms communicated at the time of purchase or booking.

18. Dispute Resolution

18.1 We encourage you to contact us first at hello@breatheandbelieveglobal.com if you have any concerns or disputes. We will make reasonable efforts to resolve any issues informally before pursuing formal proceedings.

18.2 For users located in the European Union, you may also submit a complaint through the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.

18.3 For users located in the United Kingdom, you may seek assistance from relevant UK consumer protection bodies or alternative dispute resolution schemes where applicable.

18.4 For all other disputes, the provisions of Section 20 (Governing Law and Jurisdiction) shall apply.

19. Force Majeure

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, government restrictions, or other events outside our reasonable control.

20. Governing Law and Jurisdiction

20.1 These Terms shall be governed by and construed in accordance with the laws of the State of California, United States.

20.2 For users located in the European Union, nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence, and any dispute may be brought before the courts of your country of residence.

20.3 For users located in the United Kingdom, nothing in these Terms affects your rights under UK consumer protection legislation, and disputes may be brought before the courts of England and Wales or your local courts as applicable.

20.4 For all other users, any legal action shall be brought exclusively in the courts of the State of California.

21. Entire Agreement

These Terms constitute the entire agreement between you and the Company with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.

22. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
